Sugar Plum is subject to the mortgage of Wachovia Bank, N.A. (“Wachovia”). The Developer, with Wachovia’s cooperation, has respectfully determined that development is no longer a financially viable option and wishes to immediately sell this property at today’s market price. Developer and Wachovia have determined that a sealed bid auction is the best method to definitively ensure that Sugar Plum is sold no later than October 31, 2008.

Developer has engaged The Dobbins Company, an Industrial Liquidation firm from Atlanta to handle the sealed bid offering and Jon Kohler & Associates, a real estate brokerage firm to handle the sales process.

Sugar Plum is immediately available for inspection by appointment. The inspection period shall begin on Monday, October 6, 2008, and conclude at 12:00 noon, Thursday, October 30, 2008 (the “Bidding Deadline”). The Dobbins Company must receive all bids prior to the Bidding Deadline submitted on the official bidding form. Developer intends to sell Sugar Plum to the highest bidder but reserves the option of accepting or rejecting any or all bids. Wachovia supports Developer’s auction of Sugar Plum.
